TampaDNA Terms and Conditions

These terms and conditions govern your access to and use of our services, including but not limited to TampaDNA mobile collection and testing services. By accessing or using our services, you agree to comply with and be bound by these terms. Read them carefuly before proceeding with any transactions.

Description of Services

TampaDNA provides mobile DNA collection services, meeting clients at prearranged, secure, and convenient locations such as Walgreens, WalMart, CVS, or other similar establishments including your home. Our trained personnel will perform the following services:

DNA Collection: We collect DNA samples by swabbing the inside of the cheeks of adults and children. We also photograph the client and their ID to provide accurate identification for the DNA processing lab.

Client Identification Form: Clients are required to sign a Client Identification Form, verifying the accuracy of all personal information provided. This form is necessary for the DNA processing lab to proceed with testing.

Sample Submission: Once all required samples and information are collected, they will be securely sent to the DNA processing lab for analysis.

We offer a wide range of DNA testing services, including but not limited to:

Legal Paternity Test: Provides legal documentation of paternity for court purposes

Maternity/Paternity Test: Establishes biological parentage

Y-Chromosome Test: Traces paternal lineage through the Y-Chromosome

Grandparentage Test: Confirms biological relationships between a child and their grandparents

Avuncular Test: Determines biological relationships between a child and their aunt or uncle

Siblingship Test: Establishes whether individuals are full or half-siblings

Zygosity (Twin) Test: Determines whether twins are identical or fraternal

Noninvasive Prenatal Test: Screens for genetic abnormalities in a fetus using a blood sample from the mother

Postmortem Test: Collects DNA from a deceased individual for various purposes, including identification or legal cases

Immigration Test: Provides proof of biological relationships for immigration purposes

Cat/Dog Test: Conducts DNA testing on cats/dogs for various reasons, including breed identification or health screening

Limitations of Liability and Disclaimers

No Medical Advice: TampDNA does not provide medical advice, diagnosis, or treatment. Our services are limited to the collection and processing of DNA samples. Clients are advised to consult with their healthcare professionals for any medical concerns or decisions related to their DNA test results.

Impact of Results: We are not responsible for any emotional, psychological, financial, or social consequences that may arise from the results of DNA testing. Clients should consider the potential impact of the results before proceeding with testing.

Allergies and Reactions: TampaDNA is not liable for any allergic reactions or adverse effects resulting from the use of cotton swabs or any other materials used during the DNA collection process. It is the client's responsibility to inform us of any known allergies prior to the appointment.

Test Administration by Clients: If a client administers a purchased test at home, TampaDNA is not responsible for any inconclusive or inaccurate results due to improper administration. Clients are required to follow all instructions provided with the test kit to ensure accurate results.

Authorization for Testing: TampaDNA assumes that any adult bringing a minor for DNA testing has the legal authority to do so. We are not responsible for verifying parental or guardian consent and are not liable if a test is performed without the proper authorization. It is the responsibility of the adult accompanying the minor to ensure they have the legal right to authorize the test.

Acceptance of Test Results: We do not guarantee that the results of our DNA tests will be accepted by all legal, governmental, or private entities. Clients seeking to use DNA test results for legal purposes should consult with legal counsel to ensure the test meets all necessary requirements.

Instruction Compliance: Clients must adhere strictly to all instructions provided prior to DNA collection to avoid contamination or inaccurate results. TampaDNA is not responsible for any issues arising from the client's failure to follow these instructions.

Use of Informational Content: The content provided on our website and other informational materials is for general informational purposes only and is not intended to replace the advice, diagnosis, or treatment recommendations of a healthcare professional.

Payment Terms, Refunds, and Cancellations

Non-Refundable Deposit: A non-refundable deposit of $150 is required to secure an appointment. This deposit confirms the client's commitment to the appointment and covers administrative costs associated with scheduling.

Full Payment Requirement: The full balance for the DNA test(s) must be paid no later than 24 hours prior to the scheduled appointment. Failure to complete payment within this time frame will result in the cancellation of the appointment and forfeiture of the deposit.

Third-Party Payment Processing: Payments are processed through a third-party payment service provider. TampaDNA is not responsible for any issues that may arise with the payment processing system, including but not limited to transaction failures, delays, or errors.

Binding Contract:

Service Agreement- By choosing to purchase a DNA test from TampaDNA and completing the required documentation, you enter into a binding contract for the provision of services. This contract is enforceable under applicable law. Right to Refuse or Decline Orders- TampaDNA reserves the right to refuse or decline any order at any stage of the ordering process. This includes situations where product availability is limited, inaccuracies in product descriptions are identified, inaccurate or incomplete information is provided by the client, or payment issues occur.

Order Cancellation or Decline:

Company Discretion- We reserve the right to cancel or decline any order at any point, including after submission and confirmation, for reasons such as limited product availability, inaccuracies in product descriptions, inaccurate information provided by the customer, or payment issues. In such cases, clients will be notified, and any payments made will be refunded.

Cancellation and Refund Policy:

Cold Feet at Appointment- if any participant decides not to proceed with the test at the scheduled appointment, the non-refundable deposit of $150 will be retained, and an additional $50 cancellation fee will be applied. 

Cancellations Within 48 Hours- Cancellations made within 48 hours of the scheduled appointment will be eligible for a full refund, minus the non-refundable $150 deposit and the $50 cancellation fee. 

Same Day Cancellations- Cancellations made on the same day as the scheduled appointment are non-refundable but may be rescheduled for a future date, subject to availability. 

No Call, No Show- Failure to attend a scheduled appointment without prior notice will be treated as a cancellation, and no refund will be provided. However, the appointment may be rescheduled for a future date upon mutual agreement.

Processing Cancellations- Refunds for cancellations will be processed within 15 business days of receiving the cancellation notice. Refunds will be issued to the original method of payment.

Non-Refundable Items- If the DNA collector opens any test packages at the appointment and the client decides to decline the service or the service cannot be completed due to the client's actions, no refund will be given.

Conditions for Service Refusal or Termination

Unsafe Environments- TampaDNA reserves the right to refuse, cancel, or terminate services if the environment is deemed unsafe for our staff. This includes, but is not limited to, situations involving arguments, the presence of weapons, or police involvement. In such cases, the non-refundable deposit of $150 and the $50 cancellation fee will apply.

Client Misconduct- We reserve the right to terminate services if the client or any participants engage in inappropriate behavior, harassment, or any other conduct that compromises the safety or professionalism of our staff. NO refunds will be provided in such cases.

Kit Returns and Exchanges

Damaged Kits- If a DNA testing kit is received in a damaged condition, clients may request a refund or exchange by returning the damaged kit to TampaDNA. All requests for returns or exchanges must be made within 14 days of receiving the kit.

Service and Appointment Delays

No Liability for Delays- TampaDNA is not responsible for any delays in service or appointment times. We are also not liable for any lost wages, travel expenses, or other inconveniences that may arise due to such delays. Clients are advised to plan accordingly and allow for potential delays when scheduling appointments.

Errors and Refunds

Company Errors- In the unlikely event of an error on our part in the collection or handling of your DNA sample, TampaDNA will either provide a full refund of all monies paid or offer a free retest at no additional cost. Clients must notify us of any errors within 14 days of receiving their test results.

Client Errors- TampaDNA is not responsible for errors made by clients, including but not limited to providing incorrect information, failing to follow instructions, or mishandling test kits. No refunds will be issued for errors attributable to the client.

Cancellations and Refund Requests

Written Notice Required- All cancellations must be submitted in writing via email to tampadna@outlook.com. Refund requests should include the client's name, appointment date, and a detailed reason for the cancellation.

Refunds for Services Not Rendered- If TampaDNA is unable to render services for any reason, clients will receive a full refund, including the non-refundable deposit. Refunds will be processed within 15 business days.

Legal Compliance and Dispute Resolution

Governing Law-  These terms and conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Dispute Resolution-

Mediation- any disputes arising under these terms shall first be subject to mediation. Both parties agree to make a good faith effort to resolve disputes through mediation before pursuing any other legal remedies.

Arbitration- If mediation fails to resolve the dispute, the parties agree to submit the dispute to binding arbitration in Florida. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association.

Client Responsibilities

Accurate Information- Clients are responsible for providing accurate and complete information at the time of service. TampaDNA is not liable for any issues arising from inaccurate information provided by the client.

Proper Identification- Clients must present valid government-issued identification at the time of their appointment. Failure to present proper identification may result in the cancellation of the appointment and forfeiture of any deposits or fees paid.

Test Kit Handling- If administering a test at home, clients must carefully follow all provided instructions. TampaDNA is not responsible for inaccurate or inconclusive results due to improper handling of the test kit by the client.

Confidentiality and Privacy

Client Data Protection- TampaDNA is committed to protecting the privacy and confidentiality of all client information. Personal data, including DNA test results, will be handled in compliance with applicable data protection laws.

Data Sharing- TampaDNA will not share client information with third parties without the client's explicit consent, except as is required by law to fulfill the services requested.

Client Consent

Informed Consent- By using TampaDNA services, clients confirm that they have read, understood, and voluntarily consent to these Terms and Conditions. Clients also confirm that they understand the nature of the services provided and the potential implications of the test results.

Minors- For any services involving minors, the adult accompanying the minor confirms that they have the legal authority to consent on behalf of the minor and agrees to these Terms and Conditions on the minor's behalf.

Intellectual Propery Rights

Ownership- All intellectual property rights, including but not limited to trademarks, logos, service marks, and copyrighted materials, associated with TampaDNA services and content are owned by or licensed to TampaDNA.

Restrictions- Clients are not permitted to use, reproduce, modify, distribute, or create derivative works of any TampaDNA intellectual property without prior written consent.

Client-Provided Content- If clients provide content (e.g., testimonials, images) to TampaDNA, they grant TampaDNA a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content in connection with its services and marketing efforts.

Non-Disparagement

Agreement- Clients agree not to make any false, misleading, or disparaging statements, whether written or oral, about TampaDNA, its employees, services, or business practices.

Breach Consequences- Any violation of this clause may result in legal action by TampaDNA, including but not limited to claims for defamation or breach of contract.

Indemnification

Client Indemnity- Clients agree to indemnify, defend, and hold harmless TampaDNA, its affiliates, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • The client's breach of these Terms and Conditions
  • Any negligent, reckless, or intentional misconduct by the client
  • Any third-party claims related to the client's use of the services.

Company Indemnity- TampaDNA agrees to indemnify, defend, and hold harmless the client from and against any claims, damages, or losses arising from the company's gross negligence or willful misconduct.

Severability

Clause Independence- If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from the remainder of these terms, and the remaining provisions shall remain in full force and effect.

Modification- The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the original intent of the parties.

Assignment

Client Assignment- Clients may not assign or transfer their rights or obligations under these Terms and Conditions without the prior written consent of TampaDNA.

Company Assignment- TampaDNA reserves the right to assign or transfer its rights and obligations under these Terms and Conditions to any third party, including in connection with a merger, acquisition, or sale of the business.

Entire Agreement

Integration- These Terms and Conditions, along with any documents referenced herein, constitute the entire agreement between TampaDNA and the client, superseding any prior or contemporaneous agreements, understandings, or representations, whether written or oral.

Amendments- Any amendments or modifications to these Terms and Conditions must be made in writing and signed by both parties to be valid and enforceable.

Changes to Terms and Conditions

TampaDNA reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any changes, and continued use of our services will constitute acceptance of the modified terms.

Force Majeure

Definition- TampaDNA shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, labor disputes, pandemics, government actions, power outages, or other unforeseen events ("Force Majeure Events")

Notification- In the event of a Force Majeure Event, TampaDNA will promptly notify the client of the situation and the anticipated impact in service delivery. Where possible, we will attempt to reschedule services affected by such events.

Client Rights- Clients will have the right to cancel their appointment and receive a full refund if a Force Majeure Event prevents TampaDNA from providing the agreed-upon services within a reasonable time frame.

Termination

Termination by Client- Clients may terminate their agreement with TampaDNA at any time by providing written notice. However, any deposits or fees paid up to the point of termination will not be refunded unless otherwise specified in the cancellation policy.

Termination by Company- TampaDNA reserves the right to terminate its agreement with a client at any time, with or without cause, by providing written notice. In such cases, the client will receive a refund for any services not yet rendered.

Survival- Provisions of these Terms and Conditions that by their nature should survive termination shall survive, including but not limited to clauses related to payment, confidentiality, intellectual property, indemnification, and dispute resolution.

Waiver

No Waiver- The failure of TampaDNA to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of that right or provision unless acknowledged  and agreed to by TampaDNA in writing.

Cumulative Rights- All rights and remedies provided in these Terms and Conditions are cumulative and not exclusive of any other rights or remedies that may be available under law.

Acknowledgement

By using TampaDNA services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. Your acceptance of these terms is a condition of service.
