Service Agreement
This Service Agreement ("Agreement") is made and entered into as of today, by and between TampaDNA ("Company") and the undersigned client ("Client"). By purchasing our DNA testing services, the Client agrees to the terms and conditions outlined in this Agreement.
Services Provided
Description of Services- TampaDNA offers a range of DNA testing services, which include but are not limited to:
- Maternity/Paternity- To establish biological parentage
- Legal Paternity- For legal proceedings requiring paternity verification
- Grandparentage- To determine biological relationships with grandparents
- Avuncular- To verify biological relationships with an aunt or uncle
- Siblingship- To establish biological relationships between siblings
- Zygosity (Twin)- To identify whether twins are identical or fraternal
- Noninvasive Prenatal- To determine genetic conditions in a fetus without risk
- Postmortem- To confirm relationships when one party is deceased
- Immigration- For proving biological relationships in immigration cases
- Y-Chromosome- To trace paternal lineage
All tests are conducted through partnerships with AABB accredited and CLIA certified laboratories to ensure accuracy and reliability
Appointment Scheduling-
- Availability- Appointments are subject to availability and are confirmed only upon receipt of the non-refundable deposit and any required documentation
- Scheduling- Clients must schedule their DNA testing appointment by contacting TampaDNA via phone: (656) 215-0694 or via email: tampadna@outlook.cm
- Rescheduling- If the client needs to reschedule an appointment, a minimum of 48 hours' notice is required to avoid penalties
- Pre-Test Preparation- For accurate results, it is highly recommended that adults do not eat, drink, smoke, or brush their teeth for at least 1 hour prior to taking DNA test. If a baby is being tested and is breastfeeding, it is recommended not to breastfeed the baby for at least 2 hours prior to the test
Payment Terms
Deposits and Payments-
Deposit- A non-refundable deposit of $150 is required to book an appointment. This deposit is applied toward the total cost of the service
Full Payment- The remaining balance for the test(s) must be settled no later than 24 hours before the scheduled appointment. Failure to do so will result in the cancellation of the appointment and the forfeiture of the deposit
Payment Methods- Payments can be made through Square payment processing via a phone call to (656) 215-0694. All payments are processed through a secure third-party payment processor. TampaDNA is not liable for issues arising from the payment processing system
Late Payment Policy- If full payment is not received within 24 hours before the scheduled appointment, the appointment will be canceled. The client will be required to pay the non-refundable deposit and the applicable cancellation fee to reschedule
Refunds and Cancellations
Cold Feet Appointment- If the client decides not to proceed with the test at the appointment, a non-refundable deposit of $150 will be retained, and an additional cancellation fee of $50 will be charged
Cancellations within 48 hours- Cancellations made within 48 hours of the scheduled appointment will receive a full refund minus the non-refundable deposit and a $50 cancellation fee
Same-Day Cancellations- Same-day cancellations are non-refundable but may be rescheduled at the Client's expense
No Call, No Show- Failure to attend a scheduled appointment without prior notice will be treated as a Same-Day Cancellation which is non-refundable but may be rescheduled at the Client's expense
Kit Returns and Exchanges- Home DNA testing kits are not returnable or exchangeable once they have been shipped or opened. If a kit arrives damaged or defective, it must be reported to TampaDNA within 24 hours of receipt to be eligible for replacement
Processing Cancellations- Refunds for cancellations will be processed within 15 business days from the date of the cancellation notice. Requests for cancellations must be submitted in writing via email to tampadna@outlook.com
Errors and Refunds- In the rare event of an error on TampaDNA's part in the collection, handling, or processing of your sample, a full refund or free re-test will be offered based on the nature of the error
Non-Refundable Items- If the DNA collector opens any packages to start the process and the client decides to decline the service, or if the service cannot be completed due to the client's actions, no refunds will be provided
Service Refusal and Termination
Conditions for Service Refusal- TampaDNA reserves the right to refuse, cancel, or terminate services if the environment is deemed unsafe or inappropriate. This includes:
- Disruptive behavior or arguments
- The presence of dangerous items or weapons
- Involvement of law enforcement that affects the safety of the service environment
In such cases, the non-refundable deposit of $150 and a cancellation fee of $50 will apply
Waiver Requirement- A waiver must be signed electronically or in-person at the time of appointment. Services will not be rendered without a complete waiver
Confidentiality and Privacy
Confidentiality of Results- TampaDNA is committed to maintaining the confidentiality of all test results and personal information. Results are accessible only to authorized personnel involved in the testing process
Client Responsibilities- Clients are responsible for the security of their personal information and test results once received. TampaDNA will not be liable for unauthorized access or disclosure due to client negligence
Privacy Policy- Personal and genetic information will be handled in accordance with TampaDNA's Privacy and Data Protection Policy, which is incorporated by reference into this Agreement
Dispute Resolution
Arbitration- Any disputes arising from this Agreement or related to the services provided shall be resolved through binding, confidential arbitration. Claims must be addressed individually and cannot be part of a group, class, or representative action.
Arbitration will be conducted in accordance with the rules of the American Arbitration Association and held in Florida. The decision of the arbitrator will be final and binding.
Force Majeure
TampaDNA shall not be liable for any delay or failure to perform its obligations under this Agreement due to circumstances beyond its control, including but not limited to:
- Natural Disasters
- Pandemics
- Government Actions
- Other Force Majeure Events
In such cases, TampaDNA will notify the client and take reasonable steps to minimize the impact of the delay or failure
Amendments to Terms
Changes to Agreement- TampaDNA reserves the right to amend this Agreement at any time. Clients will be notified of significant changes via email or through TampaDNA's website. Continued use of services following any changes constitutes acceptance of the revised terms
Governing Law
This Agreement is governed by and construed in accordance with the laws of the state of Florida. Any disputes that cannot be resolved through arbitration will be subject to the exclusive jurisdiction of the courts in Florida
